Given the complexities in the law, we felt we must take action with respect to alcohol sales on eChinabid. We believe it is in the best interests of eChinabid and the eChinabid community to disallow listings of certain alcohol products. eChinabid does not want to be associated with the potential unlawful sales of these items. In addition, having an unauthorized item on eChinabid may expose the individual selling or buying that item to legal liability. For example, an eChinabid user who lawfully sells fine collectible wines to a user in one place may face criminal prosecution if the transaction took place with a different eChinabid user in another place.

Collectable Containers

There may be instances where the particular collectible container is unopened and still contains an alcoholic beverage. The sale of collectible containers will be permitted so long as each of the following are met:

• The value of the auctioned item is in the collectible container, not its contents. Thus, bottles of wine are not permitted because their value is based on the wine in the bottle, and not the bottle itself.
• The auction description should state that the container has not been opened, but that any incidental contents are not intended for consumption.
• The item must not be available at any retail outlet, and the container must have a value that substantially exceeds the current retail price of the alcohol in the container.
• Sellers should take steps to ensure that the buyer of these collectibles is of lawful age in the buyer and seller's jurisdiction (generally 21 years old). Buyers and sellers must ensure that the sale complies with all applicable laws and shipping regulations in carrying out the transaction.

Pre-Approved Wine Sellers

Generally, the sale of wine on eChinabid is prohibited. However, we are allowing a small list of licensed and vetted sellers to participate in the sale of wine within a controlled environment on the site.

Because there are very stringent laws governing the sale and purchase of wine, we are limiting sales in the category to these sellers. In order to ensure that sellers and buyers comply with these laws, we have outlined strict requirements that must be met when selling or buying wine on eChinabid.

Alcohol-Related Collectibles

eChinabid is a forum for the sale of alcohol-related collectibles, including alcohol-related memorabilia, packaging and containers such as bottles, decanters or limited edition cans (provided you comply with the above policies), which are not subject to the same legal constraints.

Selling Chocolates with Liqueur in them

Food products that use alcohol for flavor do not fall within these laws and regulations. The alcohol policy only applies to alcoholic beverages.

Selling Wine- and Beer-Making Kits

Wine and beer-making kits will continue to be allowed on eChinabid, as long as the kit does not contain any alcoholic beverages. The alcohol policy only applies to alcoholic beverages themselves.
